Please read these Terms carefully. By accessing or using StatementScrub, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

1. Acceptance of Terms

By creating an account or using StatementScrub ("Service"), operated by StatementScrub ("Company", "we", "us"), you agree to these Terms of Service ("Terms"). These Terms apply to all users, including visitors, registered users, and paying subscribers. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

StatementScrub provides an AI-powered bank statement analysis platform that allows users to upload bank statement PDFs and receive automated financial analysis reports. The Service includes income verification, NSF detection, MCA loan detection, cash flow analysis, risk scoring, and related features. The Service is intended for use by financial professionals including mortgage brokers, business lenders, underwriters, and bookkeepers.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal authority to enter into these Terms. The Service is intended for business and professional use only. By using the Service, you represent that you are accessing bank statement data with the full and informed consent of the account holder or as otherwise permitted by applicable law.

4. User Accounts

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including the Gramm-Leach-Bliley Act (GLBA), the Fair Credit Reporting Act (FCRA), and any applicable state financial privacy laws. You agree NOT to: (a) upload bank statements without the account holder's express consent; (b) use analysis reports to discriminate unlawfully; (c) resell, redistribute, or sublicense the Service without written permission; (d) attempt to reverse-engineer, decompile, or extract our AI models; (e) use the Service to analyze statements for fraudulent purposes; (f) upload malware or malicious files; (g) use automated bots to scrape or abuse the Service.

6. Financial Data and Consent

You represent and warrant that: (a) you have obtained all necessary consents from individuals whose bank statements you upload; (b) your use of the analysis results complies with all applicable lending, privacy, and financial laws; (c) you will not use analysis reports as the sole basis for a credit decision in violation of the Equal Credit Opportunity Act (ECOA) or other applicable laws; (d) you are responsible for verifying the accuracy of AI-generated analysis before making any financial decisions.

7. Disclaimer — Not Financial or Legal Advice

StatementScrub provides automated analysis tools for informational purposes only. The analysis reports generated by our Service are NOT financial advice, legal advice, credit reports, or regulatory compliance determinations. You should not rely solely on our reports when making lending or financial decisions. We strongly recommend that all reports be reviewed by a qualified financial professional before being used in any lending decision. StatementScrub is not a Consumer Reporting Agency (CRA) as defined under the FCRA, and our reports are not consumer reports.

8. Intellectual Property

All content, software, algorithms, templates, and designs comprising the Service are the exclusive property of StatementScrub and are protected by United States and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of the bank statement PDFs you upload. You grant us a limited license to process those files solely to provide the Service to you. We do not claim ownership of your uploaded data.

9. Subscription and Payment

Paid plans are billed on a monthly basis. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law or at our sole discretion. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in account suspension or termination. You are responsible for all taxes associated with your use of the Service.

10. Data Security and Retention

We implement industry-standard security measures to protect your data. Uploaded PDF files are processed and deleted from our servers within 24 hours. Extracted analysis data may be retained to provide you with report history and dashboard features. For details on how we collect, use, and protect your data, see our Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STATEMENTSCRUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless StatementScrub and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any claim that your use of bank statement data violated a third party's rights.

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 8, 11, and 12) shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.

15. Changes to Terms

We may revise these Terms at any time. We will notify registered users of material changes by email or by posting a notice on our website. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
